Note! If you received holiday compensation, we cannot pay you an earnings-related daily allowance for the same period.

We are sending you this letter because we have received your application for income-related daily allowance. We may not have processed your application yet. However, we would like to remind you in advance of a change in the law on holiday compensation. This change in the law may mean that we cannot pay you any daily allowance at all for the first period of your application. 

Under a change in the law that came into force at the beginning of the year, we cannot pay you daily allowance for the same period for which you have been paid holiday compensation. 

If you have been in full-time employment for more than two weeks that ended on or after 1 January 2024 and you have received holiday compensation for this work, we cannot pay you an earnings-related daily allowance for the period to which the holiday compensation corresponds. 

For example, if you have been paid holiday compensation equal to a month’s salary, we cannot pay you any daily allowance for the first month. 
 
As a rule, we can only pay you an earnings-related allowance after the 7-day waiting period. By law, the waiting period does not expire if you cannot be paid the daily allowance because of the holiday compensation. Your situation may therefore be that the holiday compensation prevents payment first and then the waiting period prevents payment again. 

Your maximum payment period is not used up during the holiday compensation period or the waiting period.
